Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and Sharvil Khot, an individual (sole proprietor) based in Kolhapur, Maharashtra, India, operating under the name "Unclinq" ("Unclinq", "we", "us"). By creating an account or using unclinq.com or app.unclinq.com (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. What Unclinq is, and is not

Unclinq is a self-guided behavior-change tool that helps you notice and practice new responses to relationship patterns, using AI-generated coaching. It is educational and self-help in nature.

Unclinq is not therapy, counseling, or psychological treatment; not a medical device, diagnosis, or treatment; not a substitute for professional mental-health or medical care; and not an emergency or crisis service. No therapist–client or provider–patient relationship is created by using it.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are.

4. Your account

You are responsible for your account and for keeping access to your email secure, since we use email codes to sign you in. Tell us promptly at [email protected] if you suspect unauthorized access. You agree to give accurate information and to be responsible for activity under your account.

5. Acceptable use

Please don't misuse the Service. You agree not to: use it for anything unlawful or harmful; attempt to break, overload, reverse-engineer, or scrape it; abuse the AI to generate harmful content or to harass others; or resell or commercially exploit the Service without our permission.

6. Your content

The reflections and messages you write are yours. You grant us a limited licence to store and process them solely to operate and provide the Service to you (including sending relevant parts to our AI provider to generate responses, see the Privacy Policy). We do not sell your content or use it to train third-party AI models. You can export or delete your data from Settings.

7. AI limitations

Unclinq's responses are generated by AI and may be inaccurate, incomplete, or not right for your situation. Treat them as prompts for your own reflection, not as professional, medical, legal, or financial advice. You are responsible for the choices you make. Always use your own judgment and seek a qualified professional when a situation calls for one.

8. Free access, and paid plans

During this phase, core features are free. Some features may become part of a paid subscription in the future. If you subscribe, the price, billing cycle, and cancellation terms will be shown clearly before you pay, and you'll be able to cancel in-app. We don't use hidden charges, forced countdowns, or cancel-proof checkouts. Any refunds are handled according to the applicable app-store or payment-provider policy and your local consumer-law rights.

9. Intellectual property

The Service itself (the software, design, brand, and content we create) belongs to Unclinq and is protected by law. These Terms don't give you any right to our trademarks or to copy the Service, except to use it as intended.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular outcome. Behavior change is personal and not guaranteed.

11. Limitation of liability

To the fullest extent permitted by law, Unclinq and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, the Service or its AI outputs. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim (or, if you paid nothing, a nominal amount). Nothing in these Terms limits liability that cannot be limited by law.

12. Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or misuse the Service. Sections that by their nature should survive (content licence, disclaimers, liability, governing law) survive termination.

13. Governing law & disputes

These Terms are governed by the laws of India, and the courts at Kolhapur, Maharashtra will have jurisdiction over any dispute, unless mandatory consumer-protection laws in your country of residence give you other rights.

14. Changes

We may update these Terms as the Service evolves. If a change is material, we'll update the date above and let you know in the app where appropriate. Continuing to use the Service after a change means you accept the updated Terms.
